Property Confiscation (With Addendum)

Most readers of this blog have likely heard about the Cattle Battle at the Bundy Ranch. Technically, this confrontation did not involve eminent domain but rather the Bureau of Land Management and grazing rights on public lands.

Now something similar is afoot in Texas.  Before continuing to read this blog post, please go to THIS LINK to read the article and to watch the video about another possible impending land grab on the part of the Bureau Land Management.

The BLM aside, the matter of eminent domain (objected to by our Founders Thomas Jefferson and James Madison), particularly as redefined by the Kelo v. City of New London decision of 2005, should be of concern to all Americans — no matter where they live.

Prior to the Kelo decision, privately-owned land was typically not confiscated by the government and the ownership transferred to another private owner. Rather, the power of seizing private property via the power of eminent domain was restricted to certain public-use situations so as to prevent the abuse of government power:
...Jim Saleet worked in the pharmaceutical industry, paid off his house and then retired. Now, he and his wife plan to spend the rest of their days there [in Lakewood, Ohio], and pass their house on to their children.

But Lakewood's mayor, Madeleine Cain, has other plans. She wants to tear down the Saleets' home, plus 55 homes around it, along with four apartment buildings and more than a dozen businesses.

Why? So that private developers can build high-priced condos, and a high-end shopping mall, and thus raise Lakewood's property tax base.


The mayor told 60 Minutes that she sought out a developer for the project because Lakewood's aging tax base has been shrinking and the city simply needs more money.

"This is about Lakewood's future. Lakewood cannot survive without a strengthened tax base. Is it right to consider this a public good? Absolutely," says the mayor, who admits that it's difficult and unfortunate that the Saleets are being asked to give up their home....
Returning for a moment to the case of New London, Connecticut, land was confiscated from the owners of private property and ownership transferred to another private owner for "the public good."  Today, that land in New London, Connecticut, is a "temporary dump":
The case arose in the context of condemnation by the city of New London, Connecticut, of privately owned real property, so that it could be used as part of a “comprehensive redevelopment plan.” However, the private developer was unable to obtain financing and abandoned the redevelopment project, leaving the land as an empty lot, which was eventually turned into a temporary dump.
In Philadelphia, there has been another recent case involving the overreach of eminent domain in Philadelphia.

Hillary and Chelsea even paused to take pictures.
    Obama has mounted monuments of lies. And the Mother of ALL Lies, and the most blatant lie was prior to the 2012 elections, when he claimed that the Sept. 11 attack that killed our Ambassador to Libya and three Seals acting as security personnel was a “spontaneous demonstration” based on a video regarding Mohammed.
    Yes, they were Brutally Killed after they repeatedly ask for more help and security, and the rescue never came
    As we know, that was a blatant lie, but in her testimony before a congressional committee then Secretary of State Hillary Clinton famously asked “What difference does it make?”
    Obama’s lies go all the back to his Oath of Office in January of 2009, when he said,
    “I do solemnly swear that I will faithfully execute the Office of President of the United States, and will to the best of my ability, preserve, protect and defend the Constitution of the United States.”

      From the beginning of his campaign in 2008, Obama made it clear that he had "a different vision" as to what the United States should be. There is plenty of record before then as to what his "vision" is.

    2. What obama did (his speech writers) was simply use the old tactic to not be specific Or to cover all the bases in a single sentence as kerry did when he ran. People, by nature fill in the blanks with their own fantasies and vote for that. Most people never follow up to see if any of it actually happened or accept wolfey blitzkreig's explanation during his romper room show that it either happened or didn't because the evil right stood in the way.

  3. This kind of thing started with Teddy Roosevelt's taking possession by personal, presidential EDICT of vast tracts of land in the [still, largely undeveloped] American West to set aside in perpetuity as a series of National Parks.

    This was an enlightened, inherently wise decision of course, but it was ALSO the unconstitutional act of DICTATOR. Because TR was a POPULAR REPUBLICAN, it was almost unthinkable to question or challenge the decisions he made around the turn of the last century or the [decidedly undemocratic] methods he used to implement public policy.

    Lincoln got away with acting as a dictator, and that was The beginning of the End of the United States the Founders envisioned. The Progressives further eroded the power of the Constitution. That all of this was done in the guise of Wise, Humane, Enlightened policy makes it all the more deadly.

    Forcing well-intenioned sweeping decisions on an ignorant, unsuspecting public is worse than benign neglect, because so often the best of intentions carry with them hideous ramifications.

    This is what happens almost invariably whenever we desert PRINCIPLE in favor of EXPEDIENCY.

    Do the ends EVER justify the means?

  6. The Bundy issue basically boils down to....is it really Nevada land or is it Federal land....?
    According to the Constitution the Feds are not supposed to own it....but what will the EPA and all the other Federal bloodsuckers do then....?
    But of course lefties do not want to even acknowledge anything that’s written in the Constitution...
    Just trying to put the lefties concern with Bundy's so-called 'racism' into perspective..

    Has anyone else wondered why a U.S. Senator is allowed to continue to ply his influence? Is Senator Harry Reid the patriarch of a white collar, family crime syndicate? Crony capitalism does not leave a blood trail. But it does suck the lifeblood out of those effected by it.

    Regarding fellow Texan ( and immortal rascal LBJ) he never minced words. Luckily, he married well and Lady Bird remains a symbol of southern charm. LBJ was pure snake oil. But he had a blackmail list a mile long against his political opponents. Takes one, to know one. sigh

  13. I've always opined that the issue of property rights should be the flagship plank in my party's platform. It's certainly a priority within the membership of the party, and through organizations such as the Institute for Justice....but it doesn't get the it's due in party messaging to voters.

  15. Dave Miller is a decent Christian who follows what Jesus implored his followers to do: help the needy, the sick, the abandoned. Screaming Eagle prefers to slander good men like Miller for reasons we can only guess at. Maybe Screaming Eagle hasn't the ability to open his heart and look at the good in this world that people like Dave Miller accomplish. That's too bad.

  16. We may not agree, but we at least understand the rational for confiscating private property for public use. What I do not understand is the confiscation of private property, so that it can be sold to private persons in order to generate revenues for the governmental entity. But let’s go back to the beginning: who elects people who think this way?

      The term public use has now been nearly replaced by public good. In that manner has the ownership of private properties been, in essence, forced to transfer to the ownership of other private parties so as to make more money for the government.

      Let's consider this for a moment. Few of us own homes that couldn't be made to generate more governmental revenue if those home were replaced with high rises (business or residences or megamansions). And if there are more governmental revenues coming in, then there will be more parks, more schools, etc. -- all for "the public good." See how that works?

Mr. Anonymous; I don't know anything about what Screaming Eagle says, and it might be horrific and cruel aimed toward Dave Miller; but what's too bad is that some of Dave's attitudes here in America are an ideology many of us don't share, Christians or not. All of us wish him well in his support of other countries' people. I personally hope more and more 'missionaries' recognize the problems we have here and try to solve them, too.

    AOW: I don't believe that Eminent Domain is 'sexy' enough for most voters to worry about...nor is it widespread enough...YET. It's growing, but until more are affected, it's just not a voting point...

Dave Miller has stated on this blog, I believe, that he works with the poor and needy in Mexico to help them help themselves so they can thrive in their own country and not find it necessary to cross the border for a better life. In that, Dave Miller is helping to solve the problems we have here. It's too bad his message stating those goals got lost in people obsession with his politics. BTW, he's gone after liberals many times for their hypocrisy. Another fact people here choose to ignore in their zeal to slander him.

    3. I read Alex Haley's novel Roots when it was first published. Of course, the novel's main them was the evils of slavery. But I also recall another line in the book: when Kunta Kinte arrived to America, he was relieved that he was not going to end up in the cooking pot. Of course, what subsequently happened to him and other characters in the book was a tragedy and a travesty.

      The above said, I must also reiterate that this blog post is not about Cliven Bundy's statements. Rather, this blog post is about the issue of government overreach via the confiscation of property or other restrictions on property.

If you stood with Bundy and his illegal grazing on federal lands and thought that the government was excessive in trying to kick Bundy off those lands I'm sure you are standing with John Harter against a foreign corporation that is trying to steal his ACTUAL property. I guess that you believe in what that Racist Bastard Donald Sterling, the owner of the NBA’s Los Angeles Clippers, told his girlfriend not to post pictures on Instagram of herself with black people and not to bring black people to his basketball games, according to an audio recording posted by TMZ.
    In the recording, Sterling and his girlfriend are fighting over a picture she posted to Instagram of herself with NBA legend Magic Johnson, and Sterling demands that she stop “broadcasting” that she associates with black people. Sterling tells his girlfriend: “You can sleep with [black people]. You can bring them in, you can do whatever you want. The little I ask you is not to promote it on that … and not to bring them to my games.”

    Conservatives think that Hillary shouldn't run because she's going to be a grandma. These same people voted for Romney, who has 35 Grandchildren.. Nope, no double standards there.

    I'm sick and tired of slave movies and movies showing us a subservient. I'd rather stay focused on the greatness moments in our history, like the Great Hillary Clinton Lying her Fat Ass off about not being responsible for the 4 dead Americans in Benghazi

    Hannity the hack began his Racist show denouncing Bundy's racist comments and was somehow able to segue into blaming the NY Times for not covering Benghazi enough and ObamaCare is the worst thing to ever happen to this country (ahem…..9/11 maybe?). I swear I'm not drunk.

  26. I don't know why this is a surprise. Obama has stated clearly his intention of using the act to confiscate more land. As a point, Zoning can be equally destructive.. As many know, my family's farm had half zoned "open Space" essentially useless as far as value. Add Eminent Domain, and we are free no more.

    1. I just read it -- a "BLOODBOILER" if ever there was one.

      I think the only way anyone might manage to live independently today would be to emulate the GYPSIES -- keep on the move -- live only from hand to mouth -- use cash only -- don't maintain any kid of checking, savings or unvestment accounts. never tell anyone the truth about who you are, where you came from, what you now, and what you do to sustain yourself.

      It sounds insane, and certainly would be devoid of all the "comforts" and "conveniences" we've come so pathetically to depend on, but we WOULD be as free as any human being ever has been on this beautiful-but-always-chalkenging planet.

      One additional piece of advice to the would-be-free: Do all you can to maintain a straight, clean-cut, "normal" appearance. Don't dress in any way -- or do anything -- that might all attention to yourself. As you strive to be independent, you must still make every effort to APPEAR to fit in.

      Never reman anywhere long enough to attract the curiosity of local officials or potential busybodies. You must be IN the world but not OF it.

      Your motto must be SUICIDE is PREFERABLE to SLAVERY.

    Sterling has every right to tell his girl friend to stop embarrassing him by bringing the aids infected brown man that she sleeps with to HIS basketball games.
    And I do see a framed angle here, by having the Girlfriend bring up this topic while she was taping him. .
    And that those who are trying to make this a racism issue such as Magic Johnson may have his own angel and reason for this, such as buying the team at a cheap price. And that the girlfriend set him up

    These things have been getting out of hand in the media lately as if they were the only news in America. the same with Bundy, Phil Robertson, case’s etc.It's pathetic how they can smear and destroy a person like the NYSslimes did to Bundy and you all jumped on that like firkin hunger predators...all for what?     So much for Free Speech in the USA.
    So, in other words, if he had the guts to express how he felt, and said what he felt. He get a worse sentence than some guy who punches you in your face as you walk donw the street because he’s bored and is playing a “Game”

  39. This is another example in which the Left has been allowed to redefine the terms. The BLM's charge to administer the land has morphed to ownership, though their original mandate has not changed. The BLM is only authorized to administer and manage the land on behalf of the people, the true and sole owners. The Constitution is quite clear on what land the Federal Government can actually and that is an area of land not exceed 10 square miles upon which the building to house the governmental functions are to be built. We call it Washington, D.C. The Federal Government is further authorized to acquire lands in the various states for the construction of military forts/bases for the period of time it deems the facilities necessary.

    All the land we think belongs to the Federal Government, does not. Neither does it belong to the various States. It belongs wholly and solely to the American people and held in trust by the Federal Government for the benefit of the current generations and posterity.
